The Thirsty Wagon™ Mobile Bar & Catering

1. Introduction

These Terms and Conditions govern all bookings, services, and products provided by The Thirsty Wagon™ Mobile Bar & Catering (“we”, “us”, “our”) throughout Cape Town, Somerset West, and the Western Cape.

By confirming a booking or purchasing any of our services or products, you (“the Client”) agree to be bound by these Terms and Conditions.


2. Booking & Confirmation

2.1 A booking is only confirmed once:

  • A written quotation has been accepted; and

  • The required deposit has been paid.

2.2 Dates are secured strictly on a first-come, first-served basis.

2.3 We reserve the right to decline bookings at our discretion.


3. Deposits & Payments

3.1 A non-refundable deposit (amount specified on quotation) is required to secure your event date.

3.2 The remaining balance must be paid no later than:

  • 7 days before the event date (private events), or

  • As agreed in writing for corporate events.

3.3 Failure to make final payment may result in cancellation of services.


4. Cancellations & Refund Policy

4.1 Deposits are non-refundable.

4.2 Cancellations made:

  • More than 14 days before the event: balance refunded (excluding deposit).

  • Within 14 days of the event: 50% of total booking value may be payable.

  • Within 7 days of the event: full booking value may be payable.

4.3 Date changes are subject to availability and may incur additional costs.


5. Travel & Service Areas

5.1 We are based in Somerset West.

5.2 Travel terms:

  • First 15km included.

  • 15–90km charged at standard travel rates.

  • Beyond 90km subject to special quotation.

5.3 Interprovincial bookings require flatbed transport and advance planning.


6. Licensing & Alcohol Service

6.1 The Thirsty Wagon™ operates in accordance with applicable South African laws regarding alcohol service.

6.2 We reserve the right to:

  • Refuse service to intoxicated guests.

  • Refuse service to any person under 18 years of age.

  • Cease alcohol service if required for safety or legal compliance.

6.3 The Client is responsible for ensuring that the event venue permits alcohol service.


7. Venue Requirements

The Client must ensure:

  • Adequate space for the Kombi and setup

  • Safe and legal parking access

  • Level ground where possible

  • Access to power (if required)

  • Compliance with venue regulations

We reserve the right to refuse unsafe setups.


8. Damage & Liability

8.1 The Client is responsible for any damage caused by guests to:

  • The vehicle

  • Equipment

  • Glassware

  • Bar infrastructure

8.2 We are not liable for:

  • Guest behaviour

  • Loss or theft at the event

  • Weather-related disruptions for outdoor events

8.3 The Client indemnifies The Thirsty Wagon™ against claims arising from guest misconduct.


9. Force Majeure

We shall not be held liable for failure to perform services due to events beyond our reasonable control, including but not limited to:

  • Extreme weather

  • Government restrictions

  • Road closures

  • Natural disasters

  • Mechanical breakdown beyond reasonable maintenance

In such cases, we will attempt to reschedule where possible.


10. Food & Beverage Safety

10.1 All food and beverages are prepared in accordance with hygiene and safety standards.

10.2 Once service has concluded, we are not responsible for food stored or consumed outside recommended timeframes.


11. Sober Chauffeur Services

Diamond Carriage Travels operates as a separate service division. Additional terms may apply for chauffeur bookings.


12. Product Orders (High Tea, Delivery, Cocktails, Cakes)

12.1 Minimum lead times apply as stated per product.

12.2 Custom cake orders require at least 1 week’s notice.

12.3 Delivery times are approximate and subject to traffic and logistics.

12.4 Custom food and beverage products are non-refundable once production has begun.


13. Photography & Marketing

We reserve the right to use photographs and videos from events for marketing purposes unless the Client expressly requests otherwise in writing prior to the event.


14. Intellectual Property

“The Thirsty Wagon™” name, branding, logos, and vehicle identity remain the intellectual property of The Thirsty Wagon™.

Unauthorised reproduction is prohibited.


15. Privacy

Client information collected for bookings will be used solely for event coordination and communication and will not be sold to third parties.


16. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.
